but we'll start with jodie hernandez. police are connecting the dots right now. >> reporter: they're certainly trying to. tonight we know the identity of the suspect's girlfriend whose body was found inside the car he was driving last night. that woman has been identified as 46-year-old cindy tranof hesof hercules. she was kidnapped about 5:00 to 7:00 last night, taken from allegedly taken from the vallejo salon where she worked. now all of the victims have some sort of connection to the man including the two women whose bodies are believed to be those found in a vallejo house last night. >> they've been off and on for the last ten years. he had a key to the house. >> reporter: now police are trying to figure out if the man killed his former housemate, 67-year-old allen and allen's

friend mckara smart. two women reported missing last week and whose bodies are believed to be those found in allen's vallejo house last night. >> at this point the bodies were severely decomposed. it's hard to tell. >> police have arrested allen's husband in connection with explosive chemicals found at the home and are questioning him about the women. but it's the former housemate that investigators appear to be zeroing in on. a man they believe is also responsible for at least two more killings. >> in my 12 years experience, i've never seen anything like this before. it's just a matter of different -- you know, you start out with -- you're looking at one angle. the next thing you know, all the different bodies are turning up. >> investigators say the suspect in the weekend killing of a hercules man took them on a high speed chase through the bay area last night. ending inside rach monday market where chp officers shot and killed him. >> chp officers were placed in a situation in which they feared for their lives.

he was armed with a meat cleaver. >> reporter: inside the car he had been driving the badly beaten body of another woman who police now say was valdermaro's girlfriend and reported kidnapped yesterday afternoon. >> the information we have right now is that she made contact with a relative and advised them that he had taken her by force. >> reporter: police say cindy tran was the victim of frederic solace who, again, remains missing tonight. now according to police, valdemaro has h.d a confrontati with the father and son in recent weeks. he believes tran was having a romantic relationship with either the father or the son. now they are not speculating right now on a motive. but they are inside the police

department trying to figure it all out. jodie hernandez, nbc bay area news. >> complex and confusing case. thanks a lot. >> let's take a closer look at the explosives that were found inside that vallejo home. as mentioned, police arrest e charles ritenhouse. he is married to one of the deceased women. he is a chemical engineer. we still don't know exactly why it is that he kept the explosives and chemicals in his home. atf agents uncovered c-4, dynamite and huge chemicals for making bombs. they are continuing to remove the explosives from inside the home. exactly what motivated the killing spree may never be known. the man police believe was behind it all is dead. and many people who knew him say he rarely revealed details about his life. nbc bay area's tracy grant is live in hercules to tell us more about this shady character.

>> reporter: well, that is what they say. and we're going to have some more information about him. but right now i want you to take a look at this. we are live at an office park here in hercules. you can see the white cadillac he is ka la escalade is that being towed. away. police believe the this is the same car that ms. allen owns. valdormaro was spotted in a similar car recently and may have dumped that car here. we spoke to some people today that said he was a quiet guy who waves and said hi a& bye but would say very little else. >> his personality matches that. >> reporter: patrick nicholas says he wasn't surprised to find out that he was a keeled blooded killer. nicholas who used to shoot

baskets in the neighborhood with him said he seemed a little unbalanced. and he had quite a temper. nicholas and several other neighbors say he would argue in public with the 63-year-old woman who lived in this home where he rented a room. allen is the same woman who police found dead inside the home today along with her friend mckara smart. the arguing got so bad that allen told valdermaro to get out. >> after he got kicked out, he would just drive around here all the time. i think he is living in his car. i would always see him over there. he would pass by. the next day he would pass by the same way. it looked like he wasn't taking a shower. >> it wasn't the first time he was kicked out of a home. a similar lawsuit was filed in march trir to evict him from an apartment complex and vallejo for not paying the rent. no one knows what he did for a living. he applied to be a security guard in a sacramento-based company and tried to get

certified as a nurse. court documents show arrests for disorderly conduct, being under the influence of public intoxication in 2001 and again in may of this year. many say they were confused about how he could afford the expensive corvette he drove. >> i know it's cool. he would always say hi to us. he would buy my brother beer. >> reporter: now i want you to take another look right behind us in the office park where they are still working on putting that cadillac escalade on the back of a toe truw truck where will be taken to the police station and used in the investigation linked with so many other crimes that have happened in the last few days. the woman we spoke to, mona ortiz, says that valdermoro would come to her house and ask her brother to teach him how to do tricks in his corvette, especially donuts. she says she still can't believe

a week ago valdermoro was hold are her 2-year-old nephew in his arms. and tonight he's accused of killing a long list of people. live in hercules, tracy grant, nbc bay area news. >> a long list of warning signs. who could have predicted this. thank you. we'll continue our coverage of the store story at 11:00 tonig. firefighters are trying to get a fire in the upper county. there was a lot of dry brush around that fueled the flames. about 10 to 12 acres burned so far and fire crews are building containment lines. now the fire dangers are only going to get worse as the week wears on. temperatures getting hotter around the bay area. jeff ranieri joins us to show us how things are going to get hot. jeff? >> yeah, lisa. we've seen a 10 to 15-degree jump in the temperatures this afternoon as compared to

yesterday. plenty of mid 9 o's ut there right now. 94 in livermore. 93 in san jose. even holding on to 84 in san francisco with a 95 in santa rosa. now was this the warmest of the year so far? that would be a no. last tuesday we had all time record setting heat and plenty of triple digits. but all in all, it was a hot day for many of you out there. we do have our spare the air alert which is in effect through tonight and tomorrow. and as we head into the evening hours and the morning, it's going to be a mild start with plenty of upper 60s for thursday. and then as we head through 10:00 a.m. tomorrow, another hot day with temperatures that will already be in the low to mid 80s. now coming up, we'll have details on a cooling weekend forecast and also get you the latest on hurricane earl. that's in a minute. tom? >> cooling is good, jeff. thank you very much. now to california's budget deadlock which once again is becoming a cash crisis. governor schwarzenegger talked today about the legislature's failed attempt to pass a budget.

our nbc station in sacramento shows us where the budget fight goes from here. >> reporter: empty desk and silence in the state senate today. a very different scene from what it was like just before midnight. >> order. >> as the final seconds of the legislative session ticked down, majority democrats rushed to try to get their bill passed and republicans did everything they could to run out the clock. >> we were in the middle of a role call vote when the clock struck midnight and so there was a legitimate disagreement about whether or not the vote could continue. >> reporter: in the end, that vote did continue. the bill died anyway. just as a budget bill had died earlier in the evening in both the senate and assembly. >> we were very close. >> reporter: the governor told reporters he planned to invite legislative leaders back to the negotiating table immediately. but ruled out the possibility he might leave office without a budget in place. >> it pains me of the kind of things that are happening now

and it pains me of the kind of things that would happen if we don't get a budget. >> reporter: among the bill that's did pass, one that would gradually rule back the age at which children can enter kindergarten and another would allow prison inmates to be eligible for parole. however, much watched legislation that would have banned plastic shopping bags failed in the senate by seven votes. >> the issue goes back to local government. it's been local government for a couple years now. once again, we'll see a wave of cities and counties banning plastic bags. >> well, there is no clear indication tonight when the governor and legislative leaders might meet again if, in fact, they do. the governor said today he does not think the lack of a budget is any reason for him to cancel a planned trade trip to asia next week. next, we'll take you inside the multimillion dollar dream home you could win in the name of charity. apple downsizing again. we're not talking about jobs. we're talking about the products. we'll show you why steve jobs

the only televised debate for barbara boxer is set to begin in less than an hour. boxer, the democratic incumbent and challenger carly fiorina will confront each other at st. mary's college. that is where cheryl hurd is with a preview tonight. the stakes certainly are high. who's going to be in the

audience tonight? >> reporter: well, about 150 people will be in the audience tonight, tom. half of them students and not only is it hot outside here, those attending are hoping it will be a heated, or should i say, spirited debate. senator barbara boxer has been campaigning all over california lately. she is in the battle of her political life. recent polls show boxer and carly fiorina in a dead heat. boxer, the three term incumbent has the name recognition advantage and access to cash. compared to first time candidate carly fiorina, former hp ceo. the two started out on the wrong foot in june, you may remember, when a comment by fiorina about boxer's hair got a lot of media attention. meanwhile, the backdrop for tonight's debate, st. mary's college, the vice president of enrollment told me a few moments ago that the college is honored to host the event. >> our basketball team had a

you'll be helping those that need it most. >> and coming up, a battle over a much different development. why the city of san jose wants to get its own recommendation. well, our summer of extremes continues. it is too hot again, jeff. >> i know. seems like we can't get it right for a long enough period. we jumped 15 to 20 degrees today in our temperatures as we have seen this heat coming back to the bay area. 84 in san francisco. 96 in santa rosa. that's your high. take a gander down here. obviously no fog when santa cruz hits 96 degrees. mid 90s from livermore to fairfield. let's get a look at the winds. fire danger is a concern. we start to see temperatures this hot. right now they're primarily out of the northwest. 10 to 20 miles per hour. that's a slightly off shore wind with humidity at 15 to 25%. now while there's no red flag

fire warning today, heat and dry grass can still be a dangerous combination. nbc's damon trujillo is live at fire station number 33. obviously not a great time for a station to be closed due to budget cuts. >> that's absolutely right. the fire trucks are in sight behind the big doors. but the sign says it all. nobody is home. the neighborhood here at communications hill is worried about the closure of 33 does to the local fire danger. that's one stop that they are concerned about in the heat. in the east bay, one construction crew had no choice but to work in the heat. it doesn't matter if it's 70 degrees or 90, it's still this crew's job to dump the asphalt. >> the asphalt is 280 degrees and the heat and stuff. i'm not sure about the heat right now. >> reporter: they load up on plenty of water, especially

since the contract requires a quick, even pour. how do you stay cool? >> well, drink a lot of water. carry water with you. >> reporter: the mercury across the bay area didn't reach last week's level but it still required the bay area air quality management group to call in the second poor day of the year. >> what do you think of the heat? >> it's awful. i hope it gets cooler soon. >> reporter: workers say 90% of today's orders were for ice drinks. >> it's a hot day. i decided to get a green tea latte from starbucks. >> reporter: and on communications hill, the brush is dry around the relatively new homes that fit next to the closed fire station 33. the fire department concedes the closure will cause delays in response times. the local are crossing their fingers. and right now no one is sure if these doors will ever open one

more time. and we drove by several playgrounds around the south bay. nobody was playing in them. too hot. >> yeah. another big heat spell for us here in the bay area. really hard to believe that fire stations are even able to close when we see so many fires each year here throughout california. now we'll take a look here. we have high pressure continuing to sit here across the pacific. that is causing the heating all the way down to the surface. so much hot air aloft that there is no chance of any fog forming to night. we're looking at more mild temperatures here in the sounl b south bay by 6:00 a.m. popping up to the low 80s in the south bay. sunny skies expected yet again for thursday's forecast. tonight, it's going to be mild with low to mid 70s in the east bay and south bay. watch this as we hit 6:00 a.m. tomorrow. really not much in the way of cooling. a very mild start on your thursday and then by 10:00 a.m., we're already talking more low to mid 80s in the east and the south bay. another hot one for tomorrow.

you're seeing an engine explosion that caused a jet to make an emergency landing at sfo yesterday. you can see the flames start flying out of that engine. that cell phone video was posted to the web by the 224 passengers onboard that plane. now the pilot was able to land that plane without anyone getting hurt.

opening statements were delivered today in a love triangle and murder for hire case that rocked the town of los gatos. paul garcia and two other men are accused of ordering and paying for the killing of garcia's alleged romantic rival. a popular local businessman. prosecutors say both men were in love with a bartender who is expected to be a key witness during the trial. oakland's police chief is on the offensive despite major police layoffs in july. today he puts criminals on notice. in a news conference, department leaders organized a show and tell of sorts discussing august homicides and the arrests which followed. mug shots and photos of weapons used in the crimes were posted and they were meant to be a warning. >> although the incidents are unfortunate, we're bringing people into custody in a rapid amount of time. we're sending a message that you will not do this in this city and we will bring you into

custody. >> chief anthony bets didn't take all the credit. he thanked local law enforcement agencies for helping on the cases. here's your chance to weigh in on the plans to bring bart to san jose. a public meeting starts in a few minutes. the project is divided into two phases. people are invited to comment on phase one tonight. and that would include ten miles of track with two stations stretching from the future warm springs station in freemont and ending in north san jose. today's meeting starts at 6:30. >> coming up to night, if new homes aren't selling, why has san jose approved a new big development next to a sensitive knave area and against the city's recommendation. and tracking earl. we get the latest forecast on whether this storm will live up to all that hype. i'm scott budman in san francisco. apple rolled out new music and a new way to watch. we'll showte ilesit on weal'lshow it all to you coming up. l

a hostage instantoff at the discovery channel's hekadquartes in maryland is over. police shot and killed james j. lee. the three people he was holding hostage are safe. lee walked into the discovery building in silver spring at 1:00 p.m. local time waving a gun and with canisters on his back. a short time later nbc news called discovery communications mainline and ended up speaking to a man who identified himself as james lee. here's part of that exclusive interview. >> i have a gun and i have a bomb. i have several bombs stropd appo my body ready to go off. i have a device if i drop it -- if i drop it -- it will explode. >> so how long have you been working on this particular bomb? >> three weeks, three weeks or a month. >> three weeks? >> yeah. i did a lot of research.

>> experiment? >> and how many bombs, again, do you have? >> i have several. >> lee, apparently, has ties to southern california, a massachusetts newspaper reports that lee lost az job in his hometown of san diego before he became a full time environmentalist. he had been protesting at the discovery building saying the channel did more to harm the environment than help it. we're also tracking a developing story as the east coast braces for hurricane earl. evacuation orders are in place for north carolina's outer banks. those who are staying, they're stocking up on food and watter in case the roads are out for the next three or four days. others are boarding up businesses and their homes. we're tracking earl right now. how it is looking, jeff? >> this storm is very, very powerful and dangerous. really growing by all accounts out here in these warm waters of the atlanticment you can see it in full fashion here. the center of the storm system,

the eye is clearly visible. it is now parallel to florida. let's get the latest on the stats right now. this is still maintained the wind speed at 135 miles per hour. gusting to 160 in the center of the storm. now here's the track. right now it takes a parallel to the u.s. coastline. we do not at this point at least for the center line have a direct hit expected with this storm. but just keep in mind this is a forecasted track. we could still see a shift to the left which would put it into the hateras area, also kill devil hills and that's why, of course, they're putting in those vak wag evacuations in place now. that's only 70, possibly 80 miles of a shift that could have this making a direct impact here as a category three storm sometime by thursday p.m. but here at the other thing, it looks as if this storm system, even it gave a glancing blow to the carolinas, will continue right up the northeastern coastline as we head throughout

thursday night and into friday as a category two storm. we're talking about tropical storm watches and warnings all the way up the northeastern coast. this is a major system that will obviously also have quite a few travel delays in the next couple days. but big, big time concerns for the carolinas right now. >> all right. jeff, thank you very much. we have some new information tonight on that complex and bizarre murder mystery that stretches in three bay area cities. >> they've been looking for a missing man tonight. we have some information. let's go to tracy grant. have they found him yet? >> reporter: no, tom. unfortunately, they have not found frederic soliz. now they are -- police are just wrapping up an investigation in this office park. a white cadillac escalade. take a look at it. we have video of a tow truck taking that he is escalade away. they spent hours looking for

some trace of frederic solis but they have not. they have been able to confirm that is the same car that belonged to ms. allen, one of the women discovered dead in her home this morning in vallejo. police believe that valderomo who rented a room from her was the man possibly responsible for that -- those murders and for several others. now, again, police had hoped when this car someone called and reported they saw this car here in the office park, they hoped that they would find frederic solis but they were not able to. no trace of him in that car whatsoever. but vallejo police will take a look at every other thing that they were able to collect and hopefully come up with some clues. tracy grant, nbc bay area news. >> tracy, thank you very much. obviously, we'll have the latest on this investigation for you tonight at 11:00. tough news for carmakers.

auto sales last month showed the biggest dip in almost three decades and the stock was down across the board. gm was down 7%, ford 5%, toyota down 12%. the only car manufacturer up was chrysler when jumped 11%. despite bad news, the markets really popped today. bay area based companies apple and netflix saw huge gains which helped the markets move higher. the dow closed up almost 255 points to close at 10,269. the s & p gained almost 31 points. and the nasdaq gained about 63. and speaking of apple's new products but intense competition. that is the latest news today. scott budman shows us what is new for your ears and for your tv. >> reporter: well, as expected, tv was the star of the show today. apple tv is getting bigger and

the city of lahor in pakistan is in a state of emergency tonight. this video come just moments after three bombs exploded during a religious ceremony. officials say the attack targeted shiite muslims marching through the streets. 25 people were killed, at least 150 others injured. in response the marchers set fire to a police station and emergency vehicles. the explosions appear to be the latest attacks by sunni insurgents against the country's minority shiite population.

a major push for peace in the middle east will begin in less than 24 hours. israeli prime minister benjamin netanyahu and palestinian president mahmoud abbas are in washington tonight on the eve of peace talks. both netanyahu and abbas and president obama are all denouncing the recent act of violence in the west bank. hamas claimed responsibility for that violence. >> we've got a lot of work to do. there are going to be those who are going to do everything they can to undermine these talks. but we are going to remain steady. >> peace talks begin tomorrow at the state department. secretary of state hillary clinton will meet with jordan's king abdullah. the president of egypt and fo former british prime minister tony blair all in a hope to broker a lasting peace within a year. it will be a star studded telethon next week. there is going to be stand up to cancer. it will generate money for cancer research.

san jose could be sued for approving more houses. nbc bay area's vicki win joins us with that story new at 6:00. >> reporter: city leaders voted 8-2 to build 89 homes here. they say it will bring jobs and increase public access to this part of gouadalupe creek. >> sycamore habitat is the most endangered happen tat in california.

>> reporter: brian smith works for the committee for green foothills. he says the city's decision to allow construction on this 16 acre site will hurt the area's trees, birds, and steel head trout who pass through the creek. >> that's a threat to the species under the endangered species act. this is a stable and environmentally rich environment and they're going to change it by bringing in a lot of people, a lot more intense use. >> reporter: the park is in south jose and currently houses parking lots and several buildings. while some of the brook side estate homes would be nearly 200 feet from the creek, others would only be about 30 feet away. councilwoman nancy piles says the plan will add 700 additional trees as well as a condo playground and trail. >> it will be privately funded but publicly enjoyed. >> piles says 100 jobs will be created in first stage of construction and predicts the homes will sell as well as others in her district despite the economy. >> in my district, we've had a

84 in san francisco. mid 9 o's in the east bay. no records that have come in. but still, nonetheless, another streak here of big temperature contrasts from what we had the past two days. in san francisco. humidity, dangerously low. we are looking at increased fire danger even into tomorrow. but there are still no red flag fire warnings. we do not expect any wide scale winds here across the bay area, at least any extreme gusts. we do have a spare the air in effect tonight and tomorrow with the hot temperatures and that poor air quality here from the north bay down into the south bay. tonight, we're going to be fog free here as those lower level winds are going to continue off shore. hot for tomorrow once again. and still warm on the coast as well for thursday with 70s and 80s coming back. a sweet beach day right around san francisco. and for labor day weekend, well, we're going to change things up yet once again. we're looking at cooling temperatures out here. high pressure is forcing the heat right now down to the surface. and it's so strong, once again,

it's helping to he vab rate the fog, that dome of heat here across the bay area. so we'll call it hot once again for thursday's forecast. but then we'll get in on some changes by friday. note this, the fog will be returning. and that will help to drop temperatures down not only at the coastline but inland. let's look at tomorrow. the south bay, it's going to be warm here by 11:00 a.m. temperatures in the low 80s. and as we start off tomorrow, and mild start here for the east and the south bay. i also want to update you one more time just in case you're doing any traveling to the east. everyone is talking about hurricane earl as this is a major storm right now a category 4 strength. and at the current track, it looks like it could potential be bring some major impact to king devil hills and also for hateras as we head throughout tomorrow, midday and also into thursday ing as a category 3 storm. and then still looks to stay right up against the northeastern coastline. big, big time storm there for
